2d Cir CA holds Adwords are use in commerce

The Court of Appeals for the Second Circuit held the other day that Google's Adwords scheme does amount to use in commerce, and therefore can be an infringement when the keyword sold corresponds to a registered trade mark. Keywords, or Adwords, are conrtoversial things, and there is a German case before the Court of Justice of the EC at present.
