Trade marks as monoplies ...

It has been a busy week - so I have been unable to keep up with the IP news quite as well as usual. But now that I am able to look at what's been going on, I am depressed to see another example, this from the US, of what appears to be attempted monopolisation of a trade mark. Big business triumphs over small business, apparently irrespective of the merits or even the basic laws. This week, a client of mine surrendered in a similar situation, bullied by owners of non-identical trade marks registered for a wide range of goods but used on a very narrow subset. An opposition-based system is an expensive one, and that is always going to favour the people with the deepest pockets.

It's a prospect that I find deeply repugnant.
